Most early-stage startups can sponsor work visas, and the direct cost is smaller than founders expect: roughly $5,000 to $12,000 in government and legal fees for a typical H-1B or O-1, plus a few hours of your time over a few weeks. The real cost is timing and uncertainty. The H-1B is a lottery you enter once a year with no guarantee, while an O-1 or an L-1 transfer can be filed any week of the year and approved in 2 to 3 weeks with premium processing. If you only ever hire engineers who already hold green cards or citizenship, you are filtering out a large slice of the strongest people in San Francisco and New York. This post breaks down the four cases you will actually see, what each one costs and takes, and when the math is worth it.
Can a small startup actually sponsor a work visa?
Yes. There is no minimum headcount, revenue, or age requirement to sponsor an H-1B or an O-1. A 6-person seed-stage company with a real product and a funded payroll can file. What the government checks is that the role is a genuine specialty occupation, that you can pay the required wage, and that the company is a bona fide employer. A fresh raise helps here, because the ability to pay is part of what gets reviewed. The friction is rarely eligibility. It is that founders assume sponsorship is a giant legal project reserved for big companies, so they screen candidates out before they understand the four common paths. Each path has a different cost, timeline, and risk profile.
The four cases you will actually see
1. OPT and STEM OPT (the cheapest entry point)
A recent graduate on an F-1 student visa gets Optional Practical Training: 12 months of work authorization, extended to 36 months total if their degree is in a STEM field, which nearly every engineering degree is. During OPT the candidate is already authorized to work. You do not file anything or pay government fees to hire them. Your only obligations are light: enroll in E-Verify (free) and report their employment for the STEM extension. This is the lowest-cost way to hire international talent, and it is how most international engineers start their US careers.
The catch is the clock. STEM OPT runs out after about 3 years, so you and the candidate need a plan to move to H-1B or another status before it expires. Treat an OPT hire as a 3-year window in which you sponsor a longer-term visa, not as a permanent solution.
2. H-1B (the default, but a lottery)
The H-1B is the standard specialty-occupation visa and the one most engineers ask about. It runs on an annual cycle: registration in March, the lottery result soon after, and a start date of October 1 for selected petitions. There are 85,000 slots a year against far more registrations, so selection is not guaranteed. For a candidate who is not already in H-1B status, you cannot promise a start date because you cannot promise selection.
Direct costs land roughly in the $5,000 to $12,000 range all-in for a small employer, combining the filing and fraud-prevention fees with attorney fees (illustrative, not advice). You also have to file a Labor Condition Application and pay at least the prevailing wage for the role and location, which in SF or NYC for a software engineer is high anyway, so it rarely binds for a real market-rate offer.
Two details save startups real time. First, if a candidate already holds an H-1B at another employer, you file a transfer (technically a new petition with a different employer), which is not subject to the lottery and lets them start as soon as the petition is filed under portability rules. Second, certain employers tied to universities and nonprofits are cap-exempt, meaning no lottery at all. Most startups are not cap-exempt, but the transfer path is the everyday case: poaching an engineer who is already on an H-1B somewhere else is routine and predictable.
3. O-1 (faster, no lottery, for strong profiles)
The O-1 is for people with extraordinary ability, and more engineers qualify than founders assume. It is not only for famous researchers. Evidence can include a high salary relative to the field, original contributions, press, judging others' work, membership in selective organizations, and authorship. A staff-level engineer with a strong public record, open-source impact, conference talks, or patents can often build an O-1 case. There is no annual cap and no lottery, so you can file in any month.
Costs run a bit higher than H-1B on the legal side because the petition is evidence-heavy, often $8,000 to $15,000 all-in (illustrative, not advice). With premium processing (an extra government fee) you get a decision in about 15 calendar days. For a senior or staff hire you want to start this quarter, the O-1 is frequently the fastest legitimate path. It is the one worth raising with your attorney whenever a candidate's resume reads stronger than average.
4. L-1 and TN (transfers and treaty shortcuts)
Two narrower paths are worth knowing. The L-1 moves an employee from a related foreign office to the US, which matters if you have or acquire an overseas entity. The TN is a fast, low-cost status for Canadian and Mexican citizens in qualifying professions, including many engineering roles, often processed at the border or by mail in weeks for a few hundred to a couple thousand dollars in fees. If your strongest candidate is Canadian, TN can be the easiest hire on this entire list.

When is sponsorship worth it for an early-stage company?
Compare the cost to what the role is worth. A senior software engineer in SF or NYC costs you something like $200,000 or more a year fully loaded once you add equity and overhead (see our salary breakdown). Against that, a one-time $5,000 to $15,000 sponsorship spend is a rounding error if it lets you hire a clearly stronger person. The question is almost never the fee. It is whether the timeline fits your hiring need.
- You need someone now, and the candidate is on OPT or already on H-1B. Sponsorship is nearly free or a fast transfer. Say yes without hesitation.
- The candidate has a strong profile and you can wait a few weeks. An O-1 is predictable and lottery-free. Often worth it for a senior or staff hire.
- The candidate needs an initial H-1B and you need a guaranteed October start. This is the one case where the lottery genuinely risks your plan. Have a backup.
- You are filling a junior role on a tight budget with citizen and green-card applicants lined up. The math may not justify the time, though OPT candidates still cost you nothing extra.
The sponsorship fee is a rounding error against a year of senior engineering comp. The only thing it ever really costs you is the lottery's uncertainty, and three of the four common paths skip the lottery entirely.
How does sponsoring widen your candidate pool?
A large share of the strongest engineers in SF and New York are international, many of them graduates of US programs already working here on OPT or H-1B. When your job post says nothing, candidates who need sponsorship self-select out, assuming a small company will not bother. You lose them silently and never know. Saying so plainly in the post is the cheapest way to widen the pool. A single line like "we sponsor visas, including transfers and O-1" near the bottom of the listing flips a candidate from a no to a maybe.

- 01Ask early, neutrally. A simple "will you now or in the future need sponsorship to work in the US" tells you which path applies. Ask it the same way for every candidate.
- 02Find their current status. Citizen or green card means nothing to do. OPT means a clock to plan around. Existing H-1B means a transfer. Canadian means TN. None of these should kill a strong candidate.
- 03Loop in an attorney before you commit a start date. They will confirm the path and timeline so you do not promise something the lottery cannot deliver.
- 04Put the wage and the offer at true market rate. The prevailing-wage requirement rarely binds for a real SF or NYC engineering offer, so do not lowball.
